    I filed in EB2 catagory through company A ( small size company )based on future employment
    PD- Sep/04.
    I-140- Pending.

    I am currently working with company B ( Multinational ). My current status is 5th yr H1B ending in Oct 07..Current employer ( Company B ) has finally approved to file PERM labor..

    I am struggling to decide if I should file I-485 with company A awail the current dates and at the same time continue to file PERM in next couple of months with company B..

    Would it creat any legel wrangling later on?

    I am already in my 5 th yr of h1B with company B and there is no guaranteed job opportunity with company A..

    Appreciate if any one in the forum could help resolve my situation.

    If I have I140 approved and I have 3 year extention after my 6 years on H1B. Can I get H1B transferred to a new employer and then start my Labour all over again.

    Hi Folks
    just got my GC. Now if I contract for a security clearance job, like Armed forces, or Defense related one through the same employer that sponsored by GC, CAN I BE ELIGIBLE for a waiver of the 5 years waiting period -to what extent is is waived ....100% or only part of the 5 years wait, if at all .
    My Company is a US Defense Vendor .
    Can someone pt me to the right place where all this is clarified.
    Also would the same kind of waiver apply if you work for a Govt agency or it is strictly defense...
    are there some other ways where GC-> Citz can be expedited

    I am working for my current company since 2001 and started GC process in 2003(EB3 10/2003). So far my company paid all expenses towards my GC. I applied for 485 in 8/07.

    Recently I got an offer as Manager. This is a much better position.

    If I take that offer, will my current employer have the right to cancel I-140(since he incurred all the expenses towards my GC).

    My company's current lawyer will definitely send the cancellation of G-28. in addition I am sure he will also intimate that I am not working with my current employer anymore. In addition I am also afraid he might cancel my I-140 with the intimation from my current employer. In this case, is it better for me to approach a new lawyer and send the AC21 letter attaching my new offer before my current lawyer/employer does their process.

    Do i need any other letter from my new employer other than the Offer Letter to send the AC21 letter?

    I did not tell my new employer that I am now on EAD (becoz he does not understand anything except GC or Citizenship). is it OK if I dont tell beofre I join them?

    There is no mandate about that....They can come back anytime before Aug 17 as long as their PD is on or before July 31st, 2007.....Since USCIS said it will not reject 485s without medicals, you can get the medicals done later and submit when they send you an RFE....However, make sure to keep all the applications filled in and ready for mailing except for the signatures and I-94 information of the returning individuals......

    Dear All,

    Today i read that their is a new law prohibiting the employers from filling multiple applications for the same employee.

    I have applied with 2 companies,as an employee , i have two different employers, who will file application for me.

    Is it against the current law or ?
    Pls help me asap , so that i can stop atleast one of the employer , if needed to file the application.

    Congress returned to town this week with its poll ratings even lower than President Bush's. That's because nearly all the public ever sees is Members fighting and accomplishing nothing.

    But it's not a completely accurate picture. By the time Congress adjourned for the August recess, it actually had racked up some legislative accomplishments that voters didn't appreciate.

    So perhaps a fair grade for the 110th Congress so far would be an F for style, a C-plus for effort and an Incomplete for quality of achievement. There is plenty of room for checking the box "shows improvement."

    What Congress has accomplished this year came in two bursts - the first "100 hours," when the House pushed through much of its promised "Six in '06" agenda, and the final 100 hours or so last month, when both the House and Senate processed a bevy of legislation.

    In between, what occurred was five months of nearly nonstop ugliness - failed Democratic efforts to stop the Iraq War, a fractious and futile fight over immigration reform, vengeful exercises of legislative oversight designed to discredit the Bush administration, and shouting matches between majority Democrats and minority Republicans.

    Even the pre-adjournment legislative push was clouded over by a raucous, late-night dust-up over a thwarted House GOP move to deny benefits to illegal immigrants that made for great television, doubtless reinforcing the public's impression of a Congress in total disarray.

    It's not a complete misimpression. Partisan wrangling is the dominant activity of this Congress. It makes a mockery of the fervent proclamations by leaders of both parties in January that they understood voters' dismay with endless, pointless point-scoring and the desire that Congress solve their urgent problems.

    Congress' failure to make problem-solving its dominant activity accounts for its low public esteem. Polls on public approval of Congress average 22 percent, compared with 33 percent for Bush. An NBC/Wall Street Journal poll showed that only 14 percent have confidence that Congress will do the right thing.

    But Congress has done some things right this year and notice should be taken of them.

    A statistical rundown by Brookings Institution scholars published in The New York Times on Aug. 26 showed that the current House is running well ahead of recent Congresses in terms of days in session, bills passed and hearings held. The Senate has a mixed record.

    One signal, unappreciated accomplishment was overwhelming passage of a $43 billion program designed to bolster America's competitiveness by doubling its scientific research budget and training more scientists and linguists.

    Sponsored by Sens. Lamar Alexander (R-Tenn.) and Jeff Bingaman (D-N.M.) and Reps. Bart Gordon (D-Tenn.) and Vernon Ehlers (R-Mich.), the final bill passed the House 367-57 and by voice vote without dissent in the Senate.

    Other bills passed and sent to the president this year include an increase in the minimum wage, lobbying and ethics reform and homeland security enhancements fulfilling the recommendations of the presidential 9/11 commission.

    Also on the list, but the subject of ongoing partisan division, was last-minute legislation authorizing the government to conduct no-warrant intercepts of electronic communication between two overseas parties when the messages pass through a server in the United States.

    Civil liberties groups, many Democrats and some editorial writers contend that the measure authorized "domestic spying on U.S. citizens," but the objections seem to reflect distrust of the Bush administration more than any leeway in the law to tap persons in the United States.

    Congress will revisit the issue and to the extent that controversy continues, it will reinforce public dismay that its leaders would rather fight than protect them from terrorism.

    Meanwhile, some of the claimed accomplishments of the Democratic Congress are less than stellar. Energy bills passed by both chambers fall far short of setting the nation on a path to independence. Neither contains a gasoline tax, encouragement for nuclear power or provisions to expand America's electricity grid.

    Farm legislation that passed the House limits subsidies to the richest American farmers but basically leaves intact a subsidy system for corporate farmers that artificially inflates land values, inhibits rural development, hurts farmers in poor countries and puts the U.S. in danger of world trade sanctions.

    Bush has signaled his intention to veto both the House farm bill and the Senate energy bill - and also both the House and Senate measures expanding the State Children's Health Insurance Program. The Senate SCHIP bill has funding flaws but basically is a responsible, bipartisan bill that deserves to survive a veto.

    With Congress back, the prospect is for more combat with Bush, largely over spending and Iraq. The country will be lucky to avoid government shutdowns as the two sides trade charges that the other is fiscally irresponsible.

    And a flurry of progress reports on Iraq is only stimulating new rancor, despite widespread underlying agreement that troop withdrawals need to be gradual and responsible.

    Congress and the Bush administration ought to resolve to improve their public esteem not at each other's expense, but by seeking agreement in the public interest. Admittedly, the chances are slim.

    Hi All,

    Please share your experience. This is quite urgent. My H1B(8+ year) is expiring, and my company is willing to file H1B with Engg manager role. My previous H1B or extension was files for software engineer. My GC(EB2) is filed as Software engineer, with PD as Jan 2006.

    Questions
    1) Now is it ok to file H1B with new title? What if H1B gets rejected?
    2) How does this title change affect GC? Can the GC be cancelled because the title has changed or H1B gets rejected? The engg manager role is similar to software engneer role, except people responsiblities.
    3) If the H1B gets accepted, then is there still a danger to GC? Do they verify GC papers before approving H1B?

    I have an H1B approval from USCIS, and I am trying to go to Canada for the initial visa stamping. But then i have a problem. I initially entered the country as a visitor, and married a citizen, but only after my I-94 had expired for about a week. (My petition is still pending. The company I am working for could not wait for my greencard, since its already been years since I started that process, so they went ahead and applied for the H1B visa for me). I heard that it is a problem to do the visa stamping in Canada if you have been out of status before. Is it advisable to go to Canada for the visa stamping?

    Hi,

    I�m currently on H1B, I'm planning to go back to my country for an extended period.

    Few queries
    1) Can my employer keep my H1B open and show that the job is available for me? If so, for how long can employer do that?
    I may go for six months, year or more, depending on circumstances.
    2) If after a year a new H1B is filled, by the same employer (given that old H1B cannot be opened for long) will I be able to utilize the old quota or would have to file in new quota.
    3) If I come back after a year, does the 6 year counter restarted? ie. the limit of working for six years on H1B.
    4) If my employer cancels my H1B, and after six-months or a year, a different company files a petition for H1B, will the petition fall in old quota? Or will have to wait to be filed in new quota for that financial year?

    If someone could answer my queries and help me decide, it will be very helpful.
