Can some1 help me to sort out my problem:

- I was working for a company A in L1-B which was about to expire by Dec 2006. So I applied for H1 and got the petition / application approved. I received the I94 also.
- But due to some reason, I travelled back to India and didn't submit the H1-I94 @ the port of exit.
- Now the same company A again processed me L1 in India and Im back to US after a yr. with the new L1 and never told any1 about my existing H1B visa

I need to know whether can I start looking jobs on that H1B without legal procedures?
Is there anything i have to do in order to activate my H1??

You don't get GC every month OR you are still under the influance with that open container thing.

Hi,
Company A filed I-485 (PD Aug 28, 2006). Another Company B filed for I-140 with a pre-approved labor dated Nov 23,2005. If the I-140 gets approved from Company B, can I use that to port my priority date to Nov 23, 2005? If I move to Company B after porting the PD, do I have to stay with Company B and if so how long?

(I am planning to stay with Company A for 6 months and then move to Company B using AC21. )

Can you please explain why it is restrictive compared to H1B?

Are you telling it because of 2 year home residency rule and getting waivers?

I am thinking of it because of my job continuation and spouse and family. If there is any alternative please suggest.

Is there any one in this situation?

1. Date is current(because of interfile) and received 2 year EAD
2. USCIS District Office IO cannot find whether the case is EB2 or EB3. Is it true or there any experiences?
3. Does any one know of any pattern of how long it will take to approve the case once its assigned to an Office?

Any input is greatly appreciated.

EB2: (Same Employer)
PERM: Jan 21, 2007
I-140 Approved: 07/14/2008 with PD of Jan 21, 2004.

Case Interfiled on 08/06/2008 (Attached the EB2 I-140 to the existing I-485 Application).
Hoping that interfile is success.

In the right hand column on the homepage the threads used to be listed in chronological order with the one containing the last post on top.

Now it has changed so that I get the threads listed randomly.

Tech gurus - is there a way to fix this so that I can see the latest post on top like I used to previously.

Hi Everyone,

I have completed my 6yrs H1-B and currently have 1yr h1-B extension until Jan, 2010. However, my PERM application for Green card was filed on Jan 2008 and is still on hold.

Given the above case can I still transfer my H1-B to a new employer with 3yr extension? I have heard that after the 6yr period H1-B is over sometimes there are cases where 3-yr or new 6yr period H1-B are issued. Can someone advice me whats the best scenario for me?

Hi,

I just want to know where is my "H1B Visa Extension Application" needs to apply by my employer.
Following are the details,
1. My Employer located in Virginia.
2. My current work location is Minnesota (and applying the H1extension with this Client's letter).
3. This is my second extension; i.e First H1b is for 2 years; and second H1b(i.e extension) for 3 years . all(5years) with the same employer.
4. I have approved I-140 also.

So 1) which will be the Service Center of mine to apply my H1B Extension
2) I heard Approved I-140 will be an advantage for a 3 year H1 extension application, but do this really matter if I have 3 months Purchase order or Contract with the client.

Please let me know.
