Folks,
I hate to start another thread, but judging by the number of separate threads on I-485 interviews, I thought if it makes better sense to have a common pool where we can ask questions and share experiences on these (supposedly) tense faceoffs. Our lawyers often charge a fat fee to babysit us at these interviews (I'll have to shell out $1000+travel costs for each such trip of my lawyer, a decent bloke otherwise). So it will be nice to know a little bit about these meetings (documents they ask you to bring along, questions they ask, how they behave etc.), that is, if we really need such expensive nannying, or can handle them by ourselves. So, please add your question/experience.

Hi,
I wanted to know if we can transfer an approved H1 while on OPT?

For ex Company A applies for my H1 and gets approved in May 2007 although it applies fromOct 2007. Now i get an offer from Company B before Oct 2007 say in July 2007. Can i transfer my H1 even though it starts from Oct 2007?

Since your child turned 21 even before you submitted your I-140, the answer is NO, you cannot submit I-485 for him as he is not covered by Child Status Protection Act, CSPA.

My employer is a single architect and owner of his sole proprietorship LLC firm and he filed an EB3 I-140 for me submitting the "Schedule-C" of his tax return, which shows a net profit of $57000 for the company. The prevailing wage for my architectural technician position is $35,100, and NSC is asking for my employer's personal financial documents, saying that they are not satisfied only with "Schedule-C" and �Net Profit� of his tax return and a sole-proprietor petitioner has to prove that he can sustain his household and the proffered wage. Can USCIS ask for personal finances when the net profit of the company is clearly greater than the prevailing wage? Has anyone been in the same situation? Any suggestions from the gurus?

Hi All,
We [Me(applicant) and my Wife(H4)] finally received our EAD's last week from NSC :> I have 2 questions:

1. Can i work part time.....apart from my 8 to 5 job based on my EAD. If yes, does the part time job need to be related or similar to my 8 to 5 job?

2. We had our FP done before we got our EAD's. Do we have to go back for additional FP after receiving EAD's? Anybody with similar situation?
Appreciate everyone's time.

I applied under the EB1 B at the NSC in January 2010. A month later received an RFE challenging all 6 criteria. The RFE acknowledged some of my work. I sent in more evidence in April. After 2 months of no reply - I opened a SR. Then a month later, I received an RFE again. It was the same RFE with only the date changed. There was no acknowledgemnt of the additional paperwork sent in response to the first RFE.

Any thoughts on how I should proceed.

No, you don't need the I-864. The interview letter that you got might refer to an I-864, but this is often because the local district office has standard interview letters and they are more often for family cases than employment cases. I've seen this happen often.

AP not yet received. But EADs have been received for me and my husband (primary applicant). However, my daughter is yet to receive her EAD. Anybody with a similar case? I tried calling IO in USCIS but they say that it may come any time within 90 days of the notice date (not the receipt date!):mad:

Now that the EB2 dates have moved forward till Dec 2003, how many of us expect our approvals in the coming months ? Would the bulletin move forward in coming months or would go back or may be become unavailable again ? Any thoughts ?

I hope the same forward movement happens for all EB3 applicants too.

How does one now expedite thier case if they are current ? Just by 1-800 .... calling or Infopass ?

I was just wondering why legal immigration is not generating any interest with the beloved politicians in this country. Inside the mind of these politicians... I guess their agenda is very clear.

Immigration support for illegals = hispanic votes = reelection!
Immigration support for widows = sympathy votes = reelection!
Immigration support for same sex partners = more votes = reelection!
Immigration support for serving the military = Show of patriotism = society respect!

...

But,
Immigration support for legal immigrants = what's the use = not a penny worth!!!

Does the published cumulative demand data represent

a) all pending 485 cases that include primary applicants and their dependents
OR
b) all pending 485 cases that include primary applicants only?

If say, the demand data for EB3, till 2004 says 35,000 - does this mean there are a total of 35,000 pending cases in total OR does this represent primary applicants only?

If it represents primary applicants only, what is the multiplication factor we need to use to get an approximate number for total pending 485 cases?

Guys,

I am at present on non-cap h1b and i have asked an employer to file for a new caped h1b in april 2008.

I have tentative plans of going to india in March end . In case i can't make it before april 1st back to US, can my new emplyer file for my New h1b while i am out side US...???

Is there any rule that, lates i-94 needs to be sent while aplying for h1b..???
