Every once in a while a government agency in the immigration space does the right thing. If I'm to maintain credibility and objectivity in the eyes of readers, I need to call out functional behavior when I see it -- notwithstanding that this blog is dedicated to dysfunctions in the immigration ecosystem. The agency worthy of plaudits is a unit within the Civil Rights Division of the Department of Justice known as the Office of Special Counsel for Immigration-Related Employment Practices (OSC). Under Immigration and Nationality Act (INA) 274B(c) [8 U.S. Code 1324b(c)], the OSC is charged, among...

This interesting article was posted on ILW.com
ILW.COM - immigration news: The Trials And Tribulations Of Highly Educated Immigrants (http://www.ilw.com/articles/2010,0120-donoghue.shtm)

Everyone saw this coming. It has been a steady decline in the situation in teh past 10 years.
The handwriting was on the wall for quite sometime.
They will eventually make the H1B unusable by IT firms/body shoppers.

What am I missing, how would your suggestion be interpreted as being against non indians. I don't agree with it but I am not offended by it (as a non indian). Yet another misunderstood childish argument in the life of the IV forums.:D

    Hi,

    Please advice me on below:-
1)I am on H1b visa and currently i am on bench. My 140 is approved and my H1b is expiring on sep30 ,2009. I got rfe for h1b extension asking for client letter.
Should i convert to h4 or do h1b transfer if i could be able to get someone to transfer it.

    2) Also if I go to h4 visa will my green card processing with priority date remain same if i go back to same employer and ask them to file my h1b again after i get a project. Or they again have to start the process again even with same employer. Also what if i go with different employer.

    3. If I apply for H4 visa now and in mean time i get a project before sep 30 2009, then what do I need to do. can i just ask my employer to again file h1b extension.

    4) SO if I do h1b transfer or go on h4 what are the pros and cons.

    Please let me know ASAP.

    Thanks in advance.

There is no such thing as AP Renewal, it is always a fresh application. That is the reason application does not mention anything about renewal.

    Below is my situation;

Last project ended July 17 and am out of project since then and my last pay check was for the week of July 17. I was sent a termination letter and my employer said that he will not revoke my H1B and told me to transfer my H1B ASAP. I have been trying to do a H transfer from then on but no company is willing to do since I don't have a project and every one told to find a project first.

Finally I found a project but now employers are not willing to do a transfer saying that I don't have pay stubs for almost two and half months. A few employers are suggesting to file a new H1B.

What would be the best course of actions in my situation.

Thanks much for all your feedback.

Stealth protectionism on the immigration front is surfacing again in Congress. Two odd bedfellows -- self-described socialist Sen. Bernie Sanders (D.VT) and A+ anti-immigration lawmaker, Chuck Grassley (R. IA) -- are at it again. Earlier in the year, the duo inserted the Employ American Workers Act into the stimulus legislation (the American Recovery and Reinvestment Act) -- something I called "Protectionist Turducken" -- to prevent the hiring of H-1B workers by recipients of TARP and Federal Reserve funding. On Nov. 19, they proposed the "Employ America Act," a bill (S. 2804) which would require employers of over 100 workers who...

LCAs for consultatnts definitely are challenging, since they move around so much. In your case, a new LCA is not required because the new position is in the same Metropolitan Statistical Area (basically the same town) as the old location.

In general, CIS and DOL distinguish between employees who are roving as part of their job, and those who are sent to a new location for a short term. The distinction is too complicated to go into here, but hopefully your company's attorney is well aware of it.

    Hi Guys,

A friend of mine from India is getting married to a US citizen here. She is coming here on a Fiancee visa (i believe K or V one of them). Does anyone know how long it takes to get a Green Card if you marry a Citizen?

    Any help will be appreciated.

I think it is within 6 months. Check the USCIS website for the I130 petition time frame (CSC).

Sen. Luddite Strikes Again (http://www.washingtonpost.com/wp-dyn/content/article/2007/04/26/AR2007042602257.html) -- Once more, a mystery Republican blocks electronic filing for Senate candidates, Friday, April 27, 2007

JUST AS she did on April 17, Sen. Dianne Feinstein (D-Calif.) went to the Senate floor to call for unanimous consent on a common-sense bill that would require candidates to file their campaign finance reports electronically. And just as he or she did on April 17, Sen. Ima Luddite (R-Who Knows Where) voiced opposition. This time the mouthpiece was Sen. Jim Bunning (R-Ky.). "On behalf of the Republican side," he said, "I object." We object to the obstruction.

Honestly, what is the big deal here? Filing campaign finance reports electronically has been standard operating procedure for candidates for the House of Representatives and the White House for years -- as it has been for political parties, political action committees and "527" groups. Yet Senate candidates are still trudging down to the Senate Office of Public Records with paper copies of their reports, which are then passed along to the Federal Election Commission, which sends them to a vendor that punches in the information and zaps it back to the FEC electronically. That finally makes them widely available, sometimes too late for voters to see who's donating to whom and how the money is being spent. With this seeming fear of modernity, it's a wonder the Senate isn't calculating budgets with an abacus. Or is it a fear of disclosure?

After the bill was blocked, Ms. Feinstein, chairman of the Senate Rules and Administration Committee, said, "It is very hard for me to understand who could oppose this and what their reason for opposing it could be." It is very hard for us, too. Sen. Luddite -- whoever he or she may be -- should come out of the shadows and explain the irrational fear that is keeping the Senate from joining the rest of us in the 21st century. Senator anonymous -- Another Day, Another Hold On Finance Bill (http://www.washingtonpost.com/wp-dyn/content/article/2007/04/26/AR2007042602249.html) By Matthew Mosk (http://projects.washingtonpost.com/staff/email/matthew+mosk/), Washington Post Staff Writer, Friday, April 27, 2007

    Sen. Anonymous struck again yesterday.

The infamous unnamed senator (or senators) has for more than a week blocked passage of legislation that would require Senate candidates to file campaign finance reports electronically.

Electronic filings would make the names of campaign donors readily available -- it's how members of the House and presidential candidates have been doing it for years. When Sen. Russell Feingold (D-Wis.) first brought the bill to the floor last week, though, he was told that an unnamed lawmaker objected.

Long-standing Senate custom allows the objection of a single senator to stop a bill in its tracks -- it's known as a secret hold. A measure that passed the Senate earlier this year, and awaits a House vote, would eliminate the practice.

The hold unleashed a torrent of activity on the Internet, as bloggers tried to flush out the identity of the senator responsible for the hold. But after an onslaught of phone calls to Senate offices, the bloggers have no answer. No one owned up to being the culprit.

Yesterday, the bill's sponsor tried again. And again, the Republican floor leader objected. A spokesman for Senate Minority Leader Mitch McConnell (R-Ky.) said he is sure the name of the secret senator is known "in the cloakroom," but he said that misses the point.

"A hold can't stop something from coming to the floor," Don Stewart said. "It can only stop it from being pushed through without a full and open debate on the bill."

That's true -- sponsors had been trying to pass the bill by unanimous consent, which does not permit amendment or debate. But Feingold told the liberal blog Daily Kos that the path was typical for a bill with 35 bipartisan co-sponsors that did not elicit a single objection in committee.

Writing on the blog yesterday, Feingold said: "The fact is that someone anonymously blocked the bill, . . . that person has made no effort to resolve his or her concerns with us, and the Republican leadership won't even tell us who that person is."

I have I-140 approved and waiting for PD to become current. Wife , however, is from ROW country and i am looking to applying I-485 for both of us using Cross Chargeability.

Is Cross Chargeability guaranteed to work or do USCIS employees have a discretion if they approve it or not ?

After researching a lot it seems like lot of people have had a hard time in being successful in conveying their CC eligibility to USCIS. What is the difficulty in conveying CC eligibility to USCIS? It seems like people mentioned about their CC in a cover letter to their I-485 but USCIS would miss reading or understanding this information. What is the secret to successfully conveying CC eligibility to USCIS ?

    Thanks in advance!
    TK

The New York Times today reports on a surgery that is heroic in scope. Japanese-born Tomoaki Kato, a surgeon at New York Presbyterian Hospital/Columbia led a 43-hour operation to remove a massive tumor(the size of a football) that had engulfed the liver and other vital organs of a 59 year old man who had been told the tumor was inoperable. Dr. Kato is a pioneer in ex vivo resections which are surgeries where the affected organs are taken outside the body, operated on to remove tumors and then sewed back in. The surgery seems to have succeeded and this pioneering...

Nikon is taking their time with this one, as they're taking their time with the WT-3 transmitter for the D200. I am interested, but by now I've invested a bit too heavily in a DNG-based workflow by converting everything to DNG and attaching IPTC metadata, to consider Capture NX as a serious contender for my workflow. Though, I do imagine that I'd use it for those rare times when I need a really high quality conversion for very large printing.
