Is it possible to obtain a Greencard from L1B status? If yes, how long does this process typically take? My understanding is it is possible and definitely easier/shorter than being on H1?

The New York Times carried on its front page this morning a Nina Bernstein article that will no doubt cause a shake up at Immigration and Customs Enforcement over what can only be described as a major scandal in the way the agency has dealt with sick detainees at the agency's detention facilities around the country. The details described by Bernstein will no doubt enrage you. The obvious monumental effort Ms. Bernstein put in to bringing this story will also likely move her on to the short list for a Pulitzer Prize for this hard-hitting piece of journalism.

Hi there,
I have this question.
I have got the green card along with some of my family members except my older child who was 21 at the time of my I-140 application.
I filled out an I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN last December and it was approved last month.
I am a bit confused as on the approval notice it is said that in 90 days National Visa Center is going to send the beneficiary a set of instructions. Calling NVC myself I was told that they are not going to sent anything, it is supposed to wait for a visa number to become available and they are working now on visa cases from 2002!
Does anybody has an idea how this is working and how long it will take to get a "visa number" and a green card? Is the origin country (Romania) of any significance in terms of time?

My current H1 expired on 7/9, I applied h1 extension (with approved I140) on 6/30/10 with client letter (with no end date) and other documents. I got approval last week, they approved my petition from 11/18/2010 - 11/17/2011. 10th year extension.
1. What is my status between 7/10/10 - 11/17/2010?.
2. Do i need to inform USCIS?
3. I expected 3 years, but I got only one year.
Is anybody faced similar situation or any suggestion.

Has anyone seen this pattern before for any service center? A "processing times" entry missing? Could this be just an accident, or are they sending the I-140's to another service center? This could mean a LOT to people who sent their I-140's and I-485's concurrently to TSC.

If she gets J1 visa, then she would have to stay outside of US for 2 years at the end of J1 visa before she can get her greencard (even if you become citizen and apply for her). Another option would be that she would have to work in medically underserved region for 2-3 years to obtain J1- waiver, before she can apply for greencard.
None of this should affect YOUR greencard approval.

USCIS has reminded all applicants for Adjustment of Status, Asylum, Legalization and Temporary Protected Status to obtain an Advance Parole (AP) document before traveling abroad. AP allows an applicant to re-enter the U.S. after traveling abroad.
In order to obtain Advance Parole, individuals must file Form I-131, Application for Travel Document to USCIS. The USCIS cautions individuals planning on traveling abroad to file Form I-131 well in advance of their travel plans (approximately 90 days before) in order to prevent possible conflicts.
We suggest all applicants of I-131 to file it in time to get the AP approval before leaving the U.S., otherwise it could have dire consequences and may result in an individual not being able to re-enter. Therefore, individuals that have a pending I-485 are encouraged to apply for Advance Parole before traveling abroad for easier re-entry if the circumstances of their current status changes.

Is it true that if you are on H4 visa and you are using Ead ...and your I-485 is denied...this invalidates your H4 status and you have to leave U.S?
I know that this situation applies only for H1B holder, not H4, the dependent.
If I'm out of H4 status...what are my options? How can I go back to H4 status?
Please advice....this is vey important for me.

Hello,
I have a h1b visa that will expire in March 2010. This visa has been already renewed for its second time so, as you know, I wont be able to renew it once again.
Currently I am applying for permanent residency ( EB3 category) and I am in the AOS phase. I have the possibility of renewing EAD's every year, but I need to understand what is going to happen when the H1b expires. Can I renew EAD's even after the visa is no longer valid? How does it work?

I applied for green card via national interest waiver category, and I decided to obtain green card through consular processing. To be eligible to get the immigrant visa in my home country, I showed consulate an offer letter from a U.S. company.
My question is , do I really have to work on that job after I enter U.S. ? Because I am not very interested in that position. And I am thinking about studying for an MBA, instead of working.
I was given a temporary green card when I entered the custom. It usually takes 2 month to get the official green card. But if I reject that offer , would my green card be revoked ?

I have my interview on March9th at Islamabad US Embassy and got a white sheet that my visa has been approved but needs further administratice processing. I have been calling PK Us Embassy and DOS every other week to check the status and got tjhe same response that it is in 'Pending'.
Just today i called in the afternoon PK US Embassy and a guy told me that my AP is in final stage and also asked me if i have my docs and PP with me or is it with us (the embassy) ?. I told him that it is with you guys and then he told me that you should be getting your docs and PP next week or early the week after. I joked with him to see if he was just making my day and he laughed and said no Sir you should be getting it next week. So at night i called DOS just to verify what is going on and DOS stated that my status is still pending.
Now i am confused as to whose telling the truth and whose telling the lie. It has been 65 days for me since the date of my interview. Anyone else experience this before ?
Any help will be highly appreciated.
