It's not official, but it sounds like the Obama Administration is getting ready to make some news. Secretary Clinton told CBS News today: �Well, we have, as you know, many Haitian Americans. Most are here legally. Some are not documented. And the Obama administration is taking steps to make sure that people are given some temporary status so that we don�t compound the problem that we face in Haiti.� That sounds like Temporary Protected Status or Deferred Enforced Departure.

if i were you, at this stage of GC drama. hold on another week and see how the GC drama continues. Then plan on your career. We have already messed our career with GC drama. So wait for a week before making any employer change...

Hi, I need your expertise, please help me. Following is my situation.
My EB3 labor priorty date was June 2003 was in pending, later same company filed in EB2 and I 140 got approved in Dec 2005.
I filed I 485 application in july 2007 and I applied in so hurry, I forgot to send a copy of I 140 approval as part of 485 filing. I got all the receipt notices.
My EB3 labor got approved before my 485 filing and I140 got approved this month
I would like to port the EB3 priority date. Please input your suggestions.

People,
I filed my I-140 at NSC, but when I check case status online it says my I-140 was transfered to another Service center. It does not say which Service center though. My lawyer says he got all his mails form CSC, which means my I-140 is pending at CSC. Also my case number starts with WAC-XXX-XXXX, which also suggests that my case is pending at CSC. However, I am not convinced if this is correct because CSC does not publish processing times for I-140. Also, recently when I filed AR-11 for an address change I got an email from USCIS with the address of TSC on it. I would like to know if anyone is in the same boat and knows which service center there case is. I will appreciate your feedback.

Any one had luck refiling I140 in EB3 for denied EB2 I140 (for same labor)?
Also is it possible to request USCIS to change an EB2 I140 denied partition to EB3 during an appeal?
It depends on several factors...
Example PERM Job requirements, reason for 140 denial...etc

1)Company A (GC sponsoring company) filed H1B 3 years extension based on approved 140 six months back and it is pending since then and got RFE .My previous H1B expired 3 months back.
2)Now i would like to switch company B by using AC21 and want to file H1B renewal also with company B.
Is it possible to file H1B renewal with company B by using pending receipt notice of H1B (that was filed by company A)? or do I need to wait until get H1B approval that was filed by Company A?
Experts please suggest?

The bill would grant two-year visas to entrepreneurs if they secure $100,000 from qualified investors. After two years, the start up must have at least five employees and $500,000 invested. My I-140 was approved in August 2009 and my PD is Jan-2004 (EB3). I want to know when i can apply for I-485, should i have to wait till my PD becomes Current or is there any other way by which i can file the I-485. Please shed some light on this topic and thanks for your time and effort.

No. You are forgetting the new applications in categories that are not backlogged (i.e., EB1, and EB2-row). They will essentially come in front of most applications that are in queue in back-logged categories (EB3 and EB2-[IC]).

I applied for my EAD and AP extension on AUG 17 2009 and my EAD was expiring on AUG 29th 2009. While my wifes EAD and AP got approved, I had an RFE as I had not sent the recent photographs so I sent that and the receipt date for that was OCT 9 2009.
I continued working and got paid, after speaking to friends I realized, getting paid on a Expired EAD is not right.
I have taken a infopass to discuss this with USCIS to get an update.
One more point I wanted to make was that my payroll company doesn't know about this and doesn't care. But if I bring it up then .they might immediately terminate my employment.
How do I fix this? Please suggest.

I was laid off from Company A on H-1B in May 09. My EB2, India, I-140 was approved in Mar 09. Since PD is not current, I-485 has not been filed yet. Here are my questions:
Can I retain my PD if Company A withdraws(worst case) my I-140 petition?
If I find employment with Company B, can I still file my I-485 using Company A's I-140 petition assuming Company A provides me with an Employment Letter for future employment?
If previous step is feasible and I-485 is approved within 180days of filing, will it pose any issues if I have to invoke AC21? (since I will be working for Company B when I file I-485 with Company A) I ask this because I have 2 yrs and 4months on my H-1B off the 6yr limit and I am afraid I might run out of H-1B time before I file I-485.

My sister applied for her EAD renewal online and paid $340 for it. She filed her I 485 in Oct 2007. There are instructions on the I 765 form that there is no fee for those who filed there first EAD after July 2007. So would that fee be refunded? Has anyone experienced this kind of thing?
